Terms and Conditions of Sale
1. Purpose
These General Terms and Conditions of Sale (GTC) define the rights and obligations of the parties in the context of the online sale of creations (linocuts, illustrations, prints, etc.) offered by Atelier Saunei on the website https://ateliersaunei.com. Any order implies full acceptance of these GTC by the buyer.
2. Scope
These GTC apply to any natural person (consumer) or legal entity wishing to make a purchase on the website. For professionals, certain legal provisions specific to consumers may not apply.
3. Products
The products offered are original creations. Each product has a description. Photographs are for illustrative purposes: slight differences (colour, texture, minor artisanal defects) may exist between the photograph and the product delivered.
4. Prices and VAT
Prices are displayed in euros (€) including or excluding tax as indicated. VAT: VAT not applicable, Article 293 B of the French General Tax Code, when this applies to the seller's status. The seller reserves the right to change prices, but the price charged will be that in effect at the time the order is confirmed by the buyer.
5. Order and payment
5.1 Ordering
Orders are placed online via the cart and final payment on the website.
5.2 Accepted payment methods
Credit cards (secure payment via Stripe), PayPal, bank transfer (shipment after receipt of funds).
5.3 Security
Payments are processed through secure providers. Payment details are not stored by Atelier Saunei.
5.4 Order acceptance
The order is concluded upon receipt of payment and the confirmation sent by email to the customer.
6. Delivery
6.1 Terms
Delivery is made to the address specified by the buyer when placing the order. Atelier Saunei delivers in France, Europe and internationally.
6.2 Delivery times
Orders are generally shipped within an average of 10 business days. This period may be extended for made-to-order creations, limited editions or periods of high demand. Where a delivery date is contractually specified, Article L216-2 of the French Consumer Code allows the consumer to take action if the professional does not deliver by the agreed date.
6.3 Transfer of risk
In accordance with the Consumer Code, transfer of risk (loss, damage) occurs only upon taking possession of the goods by the consumer or the designated person.
6.4 Damaged or lost package
In the event of a delivery issue (opened, damaged or missing package), the buyer must inform Atelier Saunei via the contact form within 48 hours of receipt, with photos and evidence, to agree on a refund or reshipment (subject to procedures required by the carrier).
6.5 Delivery charges
Calculated and displayed at checkout. Carrier and rate details are available on the « Shipping » page of the website.
7. Right of withdrawal and returns
7.1 Right of withdrawal
Under Article L.221-18 of the French Consumer Code, the consumer has 14 days from receipt of the goods to exercise the right of withdrawal.
7.2 Exclusions
Under the law, the right of withdrawal does not apply to custom creations or those made to the consumer's specifications, except in case of defect or non-conformity.
7.3 How to exercise
Full details on exercising the right of withdrawal (form, procedure, conditions and applicable charges) are on the « Returns and Withdrawal » page on the website. Any request may also be sent via the contact form.
7.4 Refund
Where the right of withdrawal is validly exercised, Atelier Saunei will refund the amounts paid, in accordance with legal provisions, no later than 14 days from notification of the withdrawal decision.
8. Legal warranties
8.1 Conformity warranty
Products benefit from the legal warranty of conformity (Articles L217-4 et seq. of the French Consumer Code). In case of non-conformity, the buyer may obtain repair, replacement or refund under the legal conditions.
8.2 Hidden defects
The buyer also benefits from the warranty against hidden defects under Articles 1641 et seq. of the Civil Code.
8.3 Time limit and proof
To assert their rights, the buyer must report the defect in writing with photos/evidence. Details and time limits are set out on the « Returns and Withdrawal » page of the website.
9. Intellectual property
Creations, images, texts, designs, logos and all site content are the exclusive property of Marina Delas EI / Atelier Saunei. Purchasing a work does not transfer any exploitation or reproduction rights (except explicit written assignment).
10. Personal data
Data collected when ordering is necessary for order processing and the commercial relationship. Atelier Saunei is committed to respecting the confidentiality and security of data; the detailed Privacy Policy is available on the website.
11. Force majeure
Atelier Saunei cannot be held liable for non-performance due to events beyond its control (force majeure), including strikes, natural disasters, transport network failure, epidemic, etc.
12. Retention of title clause
Products remain the property of Marina Delas EI / Atelier Saunei until full payment of the price (including charges, accessories and any taxes).
13. Liability
The liability of Marina Delas EI / Atelier Saunei is limited to the amount of the order and may not be invoked in case of abnormal use of the product or use other than intended.
14. DISPUTE – CONSUMER MEDIATION
In the event of a dispute between the Client and the company, they shall endeavour to resolve it amicably (the Client shall send a written complaint to the professional via the contact form or, where applicable, to the professional's Customer Relations Service). In the absence of an amicable agreement or if the professional fails to respond within a reasonable period of one (1) month, the consumer Client within the meaning of Article L.612-2 of the French Consumer Code may refer the matter free of charge to the competent mediator, if a disagreement persists, listed on the list of mediators established by the Commission for the evaluation and control of consumer mediation pursuant to Article L.615-1 of the French Consumer Code, namely:

15. Governing law and jurisdiction
These GTC are governed by French law. In the event of a dispute, the French courts shall have jurisdiction, subject to mandatory rules on jurisdiction applicable to consumers.
